Any recommendations for legal assistance? I'm being charged with a misdemeanor for hindering legal trapping out the road. The situation involved an eagle I found in a trap.

Katie Lee Good for you. I'm sorry you're in trouble but sometimes doing what's right is worth the repercussions.

Katt Adair I don't.

Phyllis Scott I don't understand how you can get ticketed for that. The person who set the trap wouldn't have caught anything with an eagle in their traps.

Samantha Adams I would read the AK Dept of Fish and Game regs for trapping as there is a section in there that pertains to trapper ethics and setting traps in such a manner as to limit incidental non-fur bearer catches such as this. It could raise questions about the...See More

Katt Adair These traps are directly on the Davis Creek trail, which is legal, though not smart.

Samantha Adams I would read the regs because if I recall traps set on trails is a no go. Let me re-read

Katt Adair I read the regs. Even though this trail is in the Juneau Trail book, it is not one of the trails listed for no-trapping.
Thank you for the info about the free legal help tomorrow. I'll be there!

Brianna Karsunky Sorry, this post filled up fast before I could read the thred comments so excuse my repeated questioning. So you freed the eagle, took it to the center, but set off another trap in the process, and THIS is why you are in trouble?

Brianna Karsunky Wow. I'm stunned by the stupidity of this, I'm sorry. I've been an Alaskan all of my life, was raised in the woods hunting and trapping. This has got to be the dumbest thing that I've ever heard regarding trapping for sure. I personally believe you deserve a pat on the back and a "good job!". No good deed goes unpunished though right? Hopefully the judge will just throw this case out!

Bald eagles are protected by federal law. I would cite this protection as it does reference trapping as being prohibited although it does not refer to incidental trapping of non target species. The law protecting bald eagles should supercede the law for trapping regulation and you should argue that you were not intentionally setting the other trap any more than this particular trapper was intentionallt trapping a federally protected species.

Jesse Ross Get a good lawyer, trappers aren't ones to mess with, given its a misdeamenor tell the truth and explain what you did. You may face civil penalties if the trapper presses charges. You should have called the authorities, taking matters into your own hands only muddied the waters more.
