Bogus MBBS degrees by Sri Venkateswara University

The case deals with a person with mere Class Xth
qualifications acquiring bogus MBBS and forged
marksheets signed by Controller of Examinations
of Sri Venkateswara University, Tirupati, Andhra
Pradesh acquiring prestigious MD degree from
AIIMS. Once he acquired MD degree from AIIMS, he
neatly fooled people of three countries - India,
UK and USA with misleading credentials with
changed identity and forging Indian passport.
Ministry of External Affairs has no answer of
discrepancies in his passport made with assistance of tout/agent.

Complaint against Dr. Vankayalpati Sri
Venkateswara Prasad of AIIMS, New Delhi as
alleged by Mr. Sanjiv Kumar Jain (F. No. 268/2007).
Read : the letter dt. 18.08.2008 for information
under RTI Act, 2005 in respect of the matter with
regards to complaint against Dr. Vankayalpati Sri
Venkateswara Prasad, Children’s Medical Centre,
Krishna Institute of Medical Sciences, Hyderabad
as alleged by Mr. Sanjiv Kumar Jain.
The Ethics Committee discussed the letter dated
18.08.2008 forwarded by the Additional Secretary
& CPIO of Supreme Court of India for information
under RTI Act, 2005, . The Ethics Committee after
going through the matter decided to make the
following replies as mentioned against each:

Part - I
Q.10. What further action had been taken by
Medical Council of India with regard to my
complaint (i.e. Complaint against Dr.
Vankayalpati Sri Venkateswara Prasad as alleged by Mr. Sanjiv Kumar Jain)
Ans.: The Ethics Committee considered this matter
in great detail on 21.05.2008 and also on
30.06.2008. The Additional Secretary, Medical
Council of India, has also prepared a detailed
note on this case and after this the Ethics
Committee decided to continue investigation of
the complaint of medical negligence. The
complainant Mr. Sanjiv Kumar Jain is called today
i.e. on 15.09.2008 and the process of investigation is going on.

Q.11 The statement of Mr. Prasad dated 12.02.2008
reads – I shall be sending the discharge summary
with reports by mail in his handwriting. Did he
send those reports alongwith surgical report.
Ans.: MCI has received the discharge summary and
investigation reports but not surgical notes.
Copy of surgical notes shall be sought.

Q.12 Does Medical Council of India allows a
person registered in their IMR to keep
simultaneous multiple identities, multiple place
of births, multiple years of passing class X,
multiple graduation years (Nov. 1985, Dec. 1986,
March, 1987) multiple father’s occupation
(Agriculturist in AIIMS and Business in School)
Ans.: Shall be referred to Registration Section
of Medical Council of India since the question is
directly related with registration matters.

Q. 13 What is AB Peds (USA) which Mr.
Vankayalapati Sri Venkateswara Prasad (Declared
unknown by private by private American board of
Pediatrics) writes alongwith AIIMS MD credentials.
Ans. Shall be referred to Registration Section of
Medical Council of India since the question is
directly related with registration matters.

Q.14 What precise educational qualifications are
needed to become Neonatologist and Pediatric Intensivist.
Ans.: As per provisions of Indian Medical Council
(Professional Conduct, Etiquette and Ethics)
Regulations, 2002 the relevant Section 7.20 reads as under:-
“A Physician shall not claim to be specialist
unless he has a special qualification in that branch.”
As per the Minimum Qualifications for Teachers in
Medical Institutions Regulations, 1998, the
minimum qualification for faculties in
neonatology has been put as DM (Neonatology) /
MD(Paediatrics) with two years special training in neonatology.
Further, reference may be made to the 2nd
Schedule of IMC Act, 1956 whereby degrees awarded
by the universities of United Kingdom, Australia,
Burma, Canada etc. are recognized. Also reference
should be made to the 3rd Schedule of IMC Act,
1956, Para – 2 where Certificates/Diplomas of American Board are recognized.

Q. 15 What investigation/conclusion is derived
with regard to 71% (actual calculation shows
74.01%) marks written on AIIMS application form
0361 without seal of principal of medical college
and 2nd class degree certificate awarded by
unknown controller of Examinations of Sri Venkateswara University.
Ans.: Answer to this question has to be sought
from the authorities of AIIMS and the concerned university.

Q. 16 Can MCI or State Medical council’s register
(final registration and not provisional
registration) a medical practitioner before a
doctor gets actual MBBS degree in Convocation.
Ans.: This particular doctor is not primarily
registered with Medical Council of India. His
name appears in IMR by virtue of the registration
granted by A.P. Medical Council and registration
of the doctor can be done by the State Medical
Councils after completion of internship. The
candidates are eligible for grant of degree
anytime after completion of internship.

Q.17 MCI must have sought registration details
wide formal enquiry from A.P. Medical Council,
kindly provide certified copy of the enquiry to
AP Medical Council and their response.
Ans.: Medical Council of India has written a
letter dated 06.10.2007 to AP Medical Council but
till date MCI has not received reply from AP
Medical Council. The Ethics Committee has decided
to send a reminder to AP Medical Council.

Q.18 Since MCI holds valid registration till
date, kindly provide Mr. Venkayalapati Sri
Venkateswara Prasad’s Class Xth Pass Certificate
(not statement of marks), class XII pass
certificates and Class XII statement of 4
marks. He was asked to appear in front of MCI
Ethics Committee in Feb. 2008 with original
credentials and these certificates form the basic
pre medical qualifications and are must for identification.
Ans.: It is pointed out that this particular
doctor is not primarily registered with Medical
Council of India. The office is directed to
provide copies of documents submitted by the
doctor when he appeard before the MCI.

Q. 19 In which year did Mr. Vankayalapati Sri
Venkateswara Prasad had acquired provisional
registration with medical council.
Ans. Shall be referred to Registration Section of
Medical Council of India since the question is
directly related with registration matters.

Q. 20 In a convocation, can MBBS degree with same
registration numbers be awarded to two different
candidates. For example two cars with same registration number on road.
Ans. Only concerned university will be able to
answer these questions. It is not within the purview of Ethics Committee.

Q. 21 Does AIIMS sends all forms and certificates
for verification to MCI? The CPIO (Academic) of
AIIMS has communicated wide response to vigilance
cell no. F 5127/88-Acad. I dated June, 20, 2007,
since Mr. Vankayalapati Sri Venkateswara Prasad
had held valid MCI registration, so he was
granted admission in AIIMS in 1988 on that basis.
Ans. Shall be referred to Registration Section of
Medical Council of India since the question is
directly related with registration matters.

Q. 22 Was the MBBS degree issued by Controller of
Exams of Mr. Vankayalapati Sri Venkateswara
Prasad after 31 October, 1986 when university’s
jurisdiction ceased to exist wide AP University
of Health Sciences Act, 1986 (available for free
download at http://www.esnips.com/web/APUHS)
recognized by Medical Council of India.
Ans. Shall be referred to Registration Section of
Medical Council of India since the question is
directly related with registration matters.

Q. 23 If yes for para 21 above, kindly provide
recognition order/memo/letter or any kind of
record issued by Medical Council of India
alongwith request from Sri Venkateswara Unviersity.
Ans. Shall be referred to Registration Section of
Medical Council of India since the question is
directly related with registration matters.

Q. 24 Was the seal of SV Medical College,
Tirupati and its affiliated hospital SVRR
Hospital, Tirupati same as per records of Medical
Council of India if any exists in records of MCI.
Ans. Should be sent to the Establishment Section
of Medical Council of India for replies at their end.

Q. 25 How many universities in India, MCI has
recognized/authorized that Controller of
Examinations will award MBBS like Sri
Venkateswara University? Kindly provide list of
all such universities whose MBBS degrees are not
awarded Vice Chancellor even though they have Vice Chancellor on rools.
Ans. Should be sent to the Establishment Section
of Medical Council of India for replies at their end. 5

Q.26 When and where Mrs. V. Hema Prasad alias
Mrs. Vankayalpati Hemamalini Prasad wife of Mr.
Venkayalpati Sri Venkateswara Prasad alias 19
other identities acquired MBBS degree as she too
had started practicing recently? What is her IMR registration number
Ans.: Shall be referred to IMR Section of Medical
Council of India since the question is directly
related with registration matters.

Part – 2
Q.1 Under IPC 22, if a citizen is aware of
medical crime and if he/she does not report to
relevant authorities, he is punished under the
law. But what section of IPC, CrPC legal action
is there for authorities who have promoted crime
or are promoting ongoing organized crime by not taking prompt action.
Ans.: This particular question is not under the
purview of Medical Council of India.

Q.2 Why there is no time period set by MCI to
deal with cases which affects life and liberty in
hands of tricksters, quacks, intelligent crooks
as white collar criminals in medicine.
Ans. Regulation do not set any time frame.

Q.3 What action is taken regarding press
publication “Courses Lack MCI stamp – Deccan
Chronical 8 April, 2008”? These uncertified
doctors somehow even register themselves with AP
Medical Council and then subsequently with MCI
too. Why does MCI accepts registrations blindly
from State Medical Councils without verification
where corruption flourishes opernly?
Ans. May be sent to the Registration Section of
Medical Council of India for replies at their end.

The Ethics Committee further noted that Dr.
V.S.V. Prasad has sent a copy of doctor’s summary
and investigation reports but he has not sent
copies of surgical notes. This fact may be
informed to the complainant who has asked information under RTI Act, 2005.
Dr. V.S.V. Prasad may be asked to send copy of
papers, bed-headed hospital ticket, operative
notes, name, addresses & registration no. of
surgeons and anaesthetist who have conducted
surgical operation in this patient. This may be
sent by fax asking Dr. V.S.V. Prasad to send the
reply alongwith documents by courier within 7 days.
The Ethics Committee in the present meeting had
called the complainant Mr. S.K. Jain. He
presented himself before the meeting. The Ethics
Committee informed him that it will continue to
conduct investigations against the doctor Dr.
V.S.V. Prasad as regards medical negligence on
treatment of the case. The Ethics Committee put
some questions and obtained answers which are recorded below:
Replies by Jains to the queries raised by the Ethics Committee
Q. Why was baby shifted from Krishna Instt. of
Medical Sciences, Hyderabad to a Govt. hospital,
was this transfer done against medical advise.
Ans. Unethical behaviour and incompetent
misconduct by doctor. He did not meet the parents
many a time and baby was surgically operated on
25th December, 2004. He had not given any
surgical report to us despite our request.
Meanwhile we were in contact with doctors from
AIIMS, Doctors from America and Saudi Arabia and
all of them suggested that enough experiments has
been already done on the baby and you should go
for his peaceful departure, hence take him to a
Govt. hospital. We submitted a letter to the
Ethics Committee of KIIMS stating that if he
wants to keep the body of the baby for his on
going research and experimentation he can do so.
Otherwise he should discharge the baby so that we
can take him to Nilofar Govt. Medical Hospital to
know the exact status of our baby. On reaching
Nilofar Hospital we were told that baby has
Multiple organ failure and he servived only for
few hours. As we lost faith in the doctor’s
treatment we were force to take our baby to a
Govt. hospital for second opinion.

Q.` Did you get the baby against medical advise, kindly said yes or no?
A. Yes.

Q. Since you have said you have consulted doctors
in AIIMS and other foreign countries regarding
the status of the patient treatment. Will you be
able to provide the Ethics Committee written
statement or communication from the doctor whom you have consulted?
Ans. We can try. It was more of telephonic communication.

Q. When you took your child away from the
hospital, what was the status of the child, was he improving or deteriorating?
Ans. Deteriorating. The platlet count of the baby
was approx. 3.25 lacs at the time of admission
and it came down to approx. 13 thousands after surgery.

Q. Whether the child was operated or not?
Ans. Yes, he was operated for PDA ligation on
25th December. Discharge summary mentioned that
surgical operation was done on 25th for ligation
of PDA but we noted that the incision mark of
operation was on the right side of the abdomen.
Discharge summary given to us from the Govt.
Hospital will be submitted which indicates that
baby had multiple organ failure.

Q. Whether post mortem was conducted?
Ans. Our request was declined by the duty doctor of Nilofar Hospital.
