For saving the life of an eagle: $500 fine and 30 days in jail
« on: January 22, 2015, 09:01:12 PM »

Trap hunting is one of the worst crimes. To be prosecuted by law for saving the life of an eagle caught in a trap, and even to be sent to jail by court sentence is one of the most barbaric things to happen.

Kathleen Adair encountered an eagle stuck in two traps Dec. 24. (Photo courtesy Kathleen Adair)

A bald eagle was lying on the ground, each leg shut inside traps. When Juneau resident Kathleen Adair came across it scouting a trail for a group hike, the eagle was alive and looking at her. She spent an hour freeing it.

But there’s more to the story. Two and a half weeks later, Alaska Wildlife Troopers cited her for the hindrance of lawful trapping. She now faces a potential $500 fine and 30 days in jail.

Brianna Karsunky Wow. I'm stunned by the stupidity of this, I'm sorry. I've been an Alaskan all of my life, was raised in the woods hunting and trapping. This has got to be the dumbest thing that I've ever heard regarding trapping for sure. I personally believe you deserve a pat on the back and a "good job!". No good deed goes unpunished though right? Hopefully the judge will just throw this case out!

Samantha Adams Bald eagles are protected by federal law. I would cite this protection as it does reference trapping as being prohibited although it does not refer to incidental trapping of non target species. The law protecting bald eagles should supercede the law for trapping regulation and you should argue that you were not intentionally setting the other trap any more than this particular trapper was intentionallt trapping a federally protected species. http://www.fws.gov/midwest/eagle/protect/laws.html

The incident has two parts: the eagle and the other traps. Both are a shame!

Prosecutors dismiss case against woman who freed eagle from trap
Posted: January 23, 2015 - 12:08am

Kathleen Adair, a 39-year-old Juneau woman who was cited for hindering trapping after she saved an eagle ensnared in a trap, demonstrates how she got the bird out of the trap using a mini-trap she brought to the Dimond Courthouse Thursday afternoon. Prosecutors dismissed her case during her arraignment, saying her actions were laudable.

By EMILY RUSSO MILLER
JUNEAU EMPIRE

Prosecutors on Thursday dismissed the case against a Juneau woman who freed a bald eagle ensnared in a trap, commending her efforts as laudable.

Juneau District Attorney James Scott said his office would have “screened out” the case against 39-year-old Kathleen Adair, but he learned the Alaska Wildlife Troopers already cited her for “hindering lawful trapping.” He relied on court rules pertaining to prosecutorial discretion to dismiss the misdemeanor criminal case.

“Her actions in saving the eagle were laudable,” Scott told Juneau District Court Judge Thomas Nave during Adair’s arraignment Thursday afternoon. “She should not have to run the risk of a conviction on her record for this offense.”

“When she’s hiking and she comes across an eagle in a snare, I encourage her to rescue that eagle again, and I will screen that case out as well,” the district attorney added.

[...]

The trapper called the Alaska Wildlife Troopers to report someone had tampered with his traps, which is a criminal misdemeanor offense that can be punishable by up to a year in jail and a $10,000 fine.

There is no "lawful trapping". It is bastardly sadistic murdering of animals. If there is a law which allows that, the law-makers should be put in those traps.
